Irish developer loses final hotel appeal

In a ruling handed down in the Supreme Court on Wednesday, Mr McKillen was refused leave to appeal an earlier judgement in the Court of Appeal, ensuring that his challenge over the ownership of the Maybourne hotel group – which owns Claridge’s, the Connaught and the Berkeley – is now over.

The Supreme Court is the final court of appeal in this case and Mr McKillen, who was ordered to pay the Barclays’ costs, has no further legal avenue to challenge their interests in the hotel group.

The Court of Appeal and the High Court had previously ruled that Sir David and Sir Frederick, owners of Telegraph Media Group, had not breached any of Mr McKillen’s pre-emption rights when they built a stake in a company, which was the parent of the Maybourne group.
